RAD PBRA conversions carry additional written termination notice periods, including 30 days for nonpayment of rent

In addition to the notification requirements at 24 CFR 880.607 and in the Multifamily HUD Model Lease, the termination procedure for a RAD conversion to PBRA requires the Project Owner to give adequate written notice of termination of the lease: a reasonable period not exceeding 30 days where the health or safety of other tenants, Project Owner employees or persons residing in the immediate vicinity is threatened, or in the event of drug-related or violent criminal activity or any felony conviction; not less than 30 days in the case of nonpayment of rent and in conformance with 24 CFR part 247; and not less than 30 days in any other case, except that a shorter period provided by state or local law applies. In all other cases the requirements of 24 CFR 880.603, the Multifamily HUD Model Lease and other HUD multifamily administrative guidance govern. These provisions must be included in the project's House Rules as set out in Attachment 1E.
