Converted assistance may be moved off the existing parcel in three situations: as part of the conversion itself, post-conversion at the Project Owner's request, or where HUD terminates the HAP contract for default of the Use Agreement or the contract. All three are subject to the RAD ownership and control provisions. Post-conversion, a Project Owner may generally only request a transfer after 10 years from the effective date of the initial HAP contract, sooner only for eminent domain, natural disaster, unforeseen events or as HUD otherwise approves. HUD may approve a partial or complete transfer if the new location meets applicable site selection standards. Substantially all units covered by the initial HAP contract must remain or be replaced as a result of the transfer, and residents at the original location at the time of the request must not lose rental assistance. On a transfer of all RAD units a RAD Use Agreement is recorded on the new location and the original released; on a partial transfer one is recorded on the new location and HUD considers appropriate modifications to the original.
