A tenant receiving the earned income disregard at conversion keeps it after conversion, and its expiry is not phased in

Tenants who are employed and receiving the earned income disregard at the time of conversion continue to receive it after conversion in accordance with 24 CFR 5.617. Because the exclusion in the voucher programme is limited to persons with disabilities, HUD waives 24 CFR 5.617(b) so that all tenants who were employed and receiving the disregard at conversion, disabled or not, keep the benefit in the PBV project. The waiver reaches only those tenants; it does not create eligibility for anyone who becomes employed after conversion or who had stopped receiving the disregard before conversion. When the disregard expires for such a family, the resulting rent adjustment is not subject to the RAD rent phase-in; the rent rises immediately to the level the family's income then supports.
