Temporary relocation that passes one year makes the resident a displaced person under the URA and triggers a written 30-day election

A resident temporarily relocated to a unit outside the same building or complex of buildings for a period expected to last a year or less, whose relocation in fact exceeds one year, immediately qualifies as a displaced person under the Uniform Relocation Act and becomes eligible for all permanent relocation assistance and payments as such, in addition to and without reduction for any temporary relocation assistance already received. At that point the PHA or Project Owner must offer the resident the choice between accepting voluntary permanent relocation with that assistance and remaining temporarily relocated on updated information about when the completed RAD unit will be available, and must repeat the offer each time the relocation extends beyond the previously anticipated duration. The offer must state in writing that accepting voluntary permanent relocation terminates the right to return to the Covered Project, and the resident must be given at least 30 days to decide. Where relocation is anticipated from the outset to exceed one year the same election must be offered up front so the resident need not spend a year in temporary housing first.
