RAD expands the PBV informal hearing right to any project owner action adversely affecting a resident

RAD specifies an alternative requirement to part of 24 CFR 982.555(b). In addition to the decisions listed at 982.555(a)(1)(i) through (v), an opportunity for an informal hearing must be given to residents for any dispute a resident may have with respect to a project owner action, or an action of the contract administrator under RAD PBV requirements, that adversely affects the resident's rights, obligations, welfare or status. For a hearing required by 982.555(a)(1) the contract administrator conducts it and the hearing officer must be selected under 982.555(e)(4)(i); for any additional hearing required by RAD the project owner conducts it. There is no hearing right for class grievances or for disputes between residents not involving the project owner or contract administrator.
