RAD PBV conversions carry additional written termination notice periods drawn from section 6 of the 1937 Act

In addition to 24 CFR 983.257 on owner termination of tenancy and eviction, a RAD conversion to PBV requires adequate written notice of termination of the lease: a reasonable period not exceeding 30 days where the health or safety of other tenants, project owner employees or persons in the immediate vicinity is threatened, or in the event of drug-related or violent criminal activity or a felony conviction; not less than 30 days for nonpayment of rent and in conformance with the tenancy addendum; and not less than 30 days in any other case, except that a shorter period provided by state or local law applies. These items must be incorporated into both the Section 8 Administrative Plan and the project owner's lease including the required tenancy addendum.
