A family under-occupying a unit at conversion may stay until an appropriate-sized unit opens in the Covered Project

If a family occupies an under-occupied unit within the meaning of 24 CFR 983.260 at the time of conversion, the family may remain in that unit until an appropriate-sized unit becomes available in the Covered Project. When one becomes available, the family must move to it within a reasonable period as determined by the administering Voucher Agency. 24 CFR 983.260 is waived for current residents remaining in or returning to the Covered Project, which is what makes staying lawful in the interval. Moving to Work agencies may not modify this requirement, and Legacy Non-RAD PBV units in the same Covered Project are subject to the same terms.
