Applicants keep their date-and-time priority when a public housing waiting list is transitioned to a converting PBV project

24 CFR 983.251 continues to govern the establishment and maintenance of the waiting list for a Covered Project unless the project is covered by a remedial order or agreement. The PHA must consider how best to transition applicants off the public housing waiting list, and wherever a list relies on the date and time of application the applicants keep that priority on the list to which their application is transferred. Where a site-based list is used, the PHA must establish it in accordance with 24 CFR 903.7(b)(2)(ii) to (iv) so that applicants on the community-wide public housing list have been offered placement on the Covered Project's initial waiting list, and must maintain the list consistently with all civil rights and fair housing law. Where assistance is being transferred to another neighbourhood and the applicant would as a result only be eligible for a unit in a materially different location, the PHA must notify applicants of the transfer and of how to apply for residency at other sites. HUD specifies alternative requirements for 24 CFR 983.251(c)(2)(iii) for this transition only; after the initial list is established the PHA administers it under 24 CFR 983.251(c).
