Farm labor eligibility carries its own immigration-status test, and the general 7 CFR 3560.152(a)(1) citizenship requirement is still suspended

The status test that actually operates in farm labor housing sits inside the definition of domestic farm laborer, not in the general occupancy rule. A domestic farm laborer must EITHER be a citizen of the United States, OR reside in the United States, Puerto Rico or the Virgin Islands after being legally admitted for permanent residence, OR be a person legally admitted to the United States and authorized to work in agriculture. That third limb is broader than the 'qualified alien' standard used elsewhere in federal housing: a worker admitted on an agricultural work authorisation satisfies it. Separately, 7 CFR 3560.152(a)(1) states a general requirement that a tenant be a United States citizen or qualified alien, and 7 CFR 3560.154(a)(7) requires an applicant certification to that effect. THE IMPLEMENTATION OF BOTH WAS DELAYED INDEFINITELY at 70 FR 8503 on 22 February 2005, and the eCFR text as of the 31 August 2026 issue still carries those delay notes. Do not cite 3560.152(a)(1) as a live admission bar. What binds is the definitional test above.
