Tenant certifications must reach Rural Development within 10 days of their effective date

The borrower must submit each initial or updated Form RD 3560-8 tenant certification to Rural Development within 10 days of its effective date, and the effective date of an initial or updated certification is always the first day of a month. A borrower that misses the window is charged overage under 7 CFR 3560.203(c) and loses the Rental Assistance attached to the unit; any assistance already received becomes unauthorized assistance recoverable under subpart O.
The consequence here is unusual and worth flagging to an operator: a late FORM, with no error in the underlying eligibility determination, converts the unit to overage and forfeits its Rental Assistance. That is a cash consequence measured in months, not an audit finding that can be papered over afterwards.
