When a Rental Assistance unit becomes available the borrower must assign it in a fixed priority order: first to eligible very low-income TENANTS paying the highest percentage of their adjusted annual income for Agency-approved shelter costs; second, if the project has vacant units, to eligible very low-income APPLICANTS on the waiting list; third to eligible low-income tenants paying the highest percentage of adjusted annual income for shelter costs; fourth to eligible low-income applicants on the waiting list; and fifth to households residing in a unit for which they do not qualify on the basis of an occupancy waiver or other special approval. Assignments must be made as soon as Rental Assistance units become available. Incorrectly assigned Rental Assistance is unauthorized assistance under subpart O.
