In addition to the per-unit ceiling, on an ANNUAL basis the AVERAGE rent for a Section 538 project, taking into account all individual unit rents, must not exceed 30 percent of 100 percent of area median income, adjusted for family size. This is a portfolio-level test on the project as a whole, not a unit-level test: a project may carry units at the 115 percent ceiling provided the average across every unit stays at or below the 100 percent figure.
