A tenant of a housing unit subject to a Section 538 loan guarantee must be a United States citizen or a noncitizen who is a qualified alien as defined in 7 CFR 3565.3. Unlike the parallel citizenship conditions in the direct programmes at 7 CFR 3560.152(a)(1), 3560.154(a)(7) and 3560.254(c)(3), the eCFR carries NO effective-date note delaying implementation of this provision, so it is recorded as operative on its face.
