A 202/8 borrower must tell each assisted family, at least one year before the HAP contract term ends, what its rent will become, and must serve that notice by both mail and hand delivery

At least ONE YEAR before the end of the HAP contract term the borrower must notify each family leasing an assisted unit of any increase in what the family will be required to pay as rent as a result of the expiration. Service is DOUBLE and the notice is not effective until both halves are done: a first class letter, properly stamped and addressed, to the family at its address at the project with a proper return address; AND a copy served on any adult answering the door at the unit, or if no adult responds, placed under or through the door if possible, or else affixed to the door. The receipt date is the later of the mailing date and the date the hand service was properly given. The notice must tell the family it will bear the entire cost of the rent after expiration and that the borrower may change the rent subject to the regulatory agreement, the lease and state or local law, and must state the actual or estimated post-expiration rent, the DIFFERENCE between that rent and the family's total tenant payment under the HAP contract, and the expiration date. The borrower must then certify to HUD that families were notified and attach an example of the notice text. This applies to every HAP contract entered into under an agreement executed on or after 1 October 1981, and to earlier ones renewed or amended after 9 February 1995.
