The lease requirements for Section 202 direct loan projects are those provided in 24 CFR 891.425, which applies to capital advances under the Section 202 and Section 811 programs as well as to loans financed under subpart E of part 891. The borrower must use the lease form prescribed by HUD; the term may not be less than one year and, absent action at expiration, renews automatically for successive one-month terms; a lease for a term exceeding one year must permit the family to terminate on 30 days advance notice; and the lease must contain a provision or addendum that tenants will receive notification at least 30 days before a formal judicial eviction is filed.
