A recipient of Federal financial assistance from HUD must operate each existing housing program or activity so that the program or activity, when viewed in its entirety, is readily accessible to and usable by individuals with handicaps, and must administer programs in the most integrated setting appropriate to the needs of qualified individuals with handicaps. A recipient must modify its housing policies and practices so that they do not discriminate on the basis of handicap, unless it can demonstrate that the policy is essential to the program and that modification would result in a fundamental alteration or in undue financial and administrative burdens. When an accessible unit becomes vacant the owner or manager must, before offering it to a non-handicapped applicant, offer it first to a current occupant of another unit of the same project, or of comparable projects under common control, who has handicaps requiring the accessibility features of the vacant unit, and second to an eligible qualified applicant on the waiting list with such a handicap. A recipient employing fifteen or more persons must designate a person to coordinate compliance and adopt grievance procedures incorporating appropriate due process standards.
