The owner must adopt written tenant selection procedures that ensure nondiscrimination in the selection of tenants, are consistent with the purpose of improving housing opportunities for very low-income elderly or handicapped persons, and are reasonably related to program eligibility and an applicant's ability to perform the obligations of the lease, and must maintain a written chronological waiting list showing the name, race, gender, ethnicity and date of each person applying. Where the borrower determines an applicant is ineligible or is not selecting the applicant, it must promptly notify the applicant in writing of the determination and its reasons and of the right to request a meeting to review the rejection, which may not be conducted by the staff member who made the initial decision. The borrower may not refuse to place an otherwise eligible applicant on the waiting list where the applicant claims a Federal preference under 24 CFR part 5 subpart D. Applicant and approved-household records carrying the racial, ethnic, gender, handicap status and previous-residency data HUD requires must be retained for three years.
