The owner must adopt written tenant selection procedures that ensure nondiscrimination in the selection of tenants, that are consistent with the purpose of improving housing opportunities for very low-income elderly persons, and that are reasonably related to program eligibility and an applicant's ability to perform the obligations of the lease. The owner must maintain a written, chronological waiting list showing the name, race, gender, ethnicity and date of each person applying for the program. Where the owner determines an applicant is ineligible or is not selecting the applicant for other reasons, it must promptly notify the applicant in writing of the determination, the reasons for it and the applicant's right to request a meeting to review the rejection, and that review may not be conducted by the member of the owner's staff who made the initial decision to reject. Records on applicants and approved eligible households providing the racial, ethnic, gender and previous-residency data HUD requires must be retained for three years.
