Contracts for assistance payments under section 236 may be entered into only with respect to tenants whose incomes do not exceed 80 percent of the median family income for the area as determined by HUD, with adjustments for smaller and larger families. HUD may establish income ceilings higher or lower than 80 percent of the area median on the basis of findings that such variations are necessary because of prevailing levels of construction costs, unusually high or low family incomes, or other factors. The ceiling governs eligibility for the ASSISTANCE PAYMENTS, not occupancy of the project as such; a Section 236 project's occupancy limits come from its own regulatory agreement and from any other program layered on the unit.
