24 CFR part 247 subpart A applies to all decisions by a landlord to terminate the occupancy of a tenant in a subsidized project, and a project receiving interest reduction payments under section 236 of the National Housing Act is a subsidized project by definition. The landlord may not terminate any tenancy except on material noncompliance with the rental agreement, material failure to carry out obligations under a State landlord and tenant act, criminal activity or alcohol abuse by a covered person under 24 CFR 5.858 through 5.860, or other good cause -- and conduct cannot be deemed other good cause unless the landlord gave prior notice that the conduct would be a basis for termination. The termination notice must be in writing, state the termination date, state the reasons with enough specificity for the tenant to prepare a defence, and advise the tenant that the landlord may enforce the termination only by judicial action at which the tenant may present a defence. Service requires BOTH first class mail to the tenant at the project AND personal service or posting at the unit, and is not effective until both are accomplished. A notice on other good cause is effective no earlier than 30 days after receipt; in nonpayment cases the notice is likewise effective no earlier than 30 days after receipt, may not issue before the day after rent is due, must carry cure instructions with the amount owed itemised by month, and bars an eviction filing if the tenant pays within the 30 days.
