Owners must create verification forms for their specific verification needs and must include the language HUD requires at Figure 5-5, which recites the Title 18 section 1001 felony provision, the penalties for unauthorised disclosure, the $5,000 misdemeanour fine for obtaining information under false pretences, and the affected person's civil right of action. A verification form must state clearly and in a prominent location that the applicant or tenant may not sign the consent if the form does not clearly indicate who will provide the requested information and who will receive it. When sending a request to a third party the owner sends the form bearing the applicant's or tenant's original signature, retains a copy, and provides a copy to the applicant or tenant on request.
