An eligible project for Section 811 Project Rental Assistance is a new or existing multifamily housing project for which the development costs are paid with resources from other public or private sources and for which a commitment has been made by the applicable State agency responsible for allocating low-income housing tax credits under section 42 of the Internal Revenue Code for an allocation of such credits, or by the applicable participating jurisdiction receiving assistance under the HOME Investment Partnerships Act for assistance from that jurisdiction, or by any Federal agency or any State or local government for funding for the project from any other source. The Secretary may not provide a capital advance under 42 U.S.C. 8013(d)(1) for any project for which assistance is provided under the Project Rental Assistance paragraph.
