A Section 811 capital advance project must be operated as supportive housing for persons with disabilities for not less than 40 years, occupied only by very low-income persons with disabilities

Any project for which a capital advance is provided under 42 U.S.C. 8013(d)(1) must be operated for not less than 40 years as supportive housing for persons with disabilities, in accordance with the application for the project approved by the Secretary, and during that period must be made available for occupancy only by very low-income persons with disabilities. If the owner requests use of the project for the direct benefit of very low-income persons with disabilities and HUD determines the project is no longer needed for use as supportive housing for persons with disabilities, HUD may approve the request and authorise conversion. In a mixed-finance development under 24 CFR part 891 subpart F the owner must develop and continue to operate the same number of supportive housing units stated in the use agreement for a 40-year period, and any foreclosure, sale or other transfer must be subject to a covenant running with the land requiring continued adherence to the very low-income use restrictions.
