A recipient of Federal financial assistance from HUD must operate each existing housing program so that, when viewed in its entirety, it is readily accessible to and usable by individuals with handicaps, and must administer programs in the most integrated setting appropriate to the needs of qualified individuals with handicaps. The recipient must modify housing policies and practices so they do not discriminate on the basis of handicap, unless it can demonstrate that a policy is essential and that modification would fundamentally alter the program or impose undue financial and administrative burdens. When an accessible unit becomes vacant the owner or manager must, before offering it to a non-handicapped applicant, offer it first to a current occupant of another unit in the same project or comparable projects under common control whose handicaps require the accessibility features, and second to an eligible qualified applicant on the waiting list with such a handicap. A recipient with fifteen or more employees must designate a compliance coordinator and adopt grievance procedures incorporating appropriate due process standards.
