Section 811 is a covered housing program under VAWA, and for the Supportive Housing for the Elderly and Persons with Disabilities program the covered housing provider is the owner. The owner must develop and implement an emergency transfer plan meeting 24 CFR 5.2005(e), and has discretion to adopt new or modify existing admission preferences or transfer waitlist priorities to facilitate emergency transfers. Where a safe unit is not immediately available for a victim who qualifies for an emergency transfer, the owner must review its existing inventory and determine when the next vacant unit may be available, and must provide a listing of nearby HUD subsidized rental properties and contact information for the local HUD field office. Each year the owner must submit to HUD data on all emergency transfers requested under 24 CFR 5.2005(e), including outcomes. An applicant or tenant may not be denied admission, denied assistance, terminated from participation in, or evicted from the housing on the basis or as a direct result of being a victim, if they otherwise qualify.
