HUD may conduct periodic affirmative fair housing marketing compliance reviews throughout the life of the mortgage, and throughout the term of the HAP contract for Section 8 assisted housing, even absent any complaint. The owner must produce, on written request and with at least five days' notice of the review, the records the regulation enumerates: copies or scripts of all advertising in the housing market area including newspaper, radio and television and a photograph of any sale or rental sign at the site; brochures and other printed material; evidence of outreach to community organisations and of affirmative outreach to groups not likely to apply; evidence of instructions to employees on the nondiscrimination policy and a description of staff training; evidence of nondiscriminatory hiring and staff composition data by race and sex; applications and waiting lists; on-site sign-in lists; the selection and screening criteria; and relevant leases. Where required documentation is not filed the owner has ten days from receipt of notice before the matter is referred for possible sanctions.
