An assistance animal is a reasonable accommodation, not a pet, and a no-pets policy must yield

An animal that a person with a disability needs in order to have equal opportunity to use and enjoy a dwelling is a reasonable accommodation under 24 CFR 100.204, not a pet. A no-pets policy, a breed or weight restriction, or a pet fee applied to such an animal is a refusal to accommodate. The regulation states this directly in its own example: refusing to let a blind applicant live with a seeing eye dog because of a no-pets policy violates section 100.204.
Verified 2026-08-31 against 91 FR 17291 and 91 FR 44867: neither the 2004 Joint Statement on Reasonable Accommodations nor the 2008 Joint Statement on Reasonable Modifications appears on either withdrawal list, and both still served from hud.gov. FHEO 2020-01 and FHEO 2013-01 do appear and are withdrawn.
