The regulations enumerate the conduct that is unlawful in renting, and the list reaches ordinary operating practice rather than only outright refusal. Under 24 CFR 100.60 it is unlawful to use different qualification criteria or applications, or rental standards or procedures -- income standards, application requirements, application fees, credit analysis or approval procedures -- because of a protected characteristic; to impose different rental charges; or to evict a tenant because of a protected characteristic of the tenant or of the tenant's GUEST. Under 100.65 it is unlawful to use different lease provisions, to fail or delay maintenance or repairs, or to limit the use of privileges, services or facilities because of a protected characteristic of an owner, tenant or a person associated with them. Under 100.70 steering is unlawful: discouraging any person from inspecting or renting, exaggerating drawbacks or withholding desirable features, or assigning a person to a particular section of a development or a particular floor of a building because of a protected characteristic. Under 100.75 no notice, statement or advertisement may indicate a preference, limitation or discrimination, and that reaches oral statements and applications, flyers, brochures, signs and posters -- including selecting advertising media or locations that deny particular segments of the market information about the housing. Under 100.80 it is unlawful to provide inaccurate or untrue information about availability, including to testers, regardless of whether the tester is actually seeking housing.
