Compliance with a HUD-recognised safe harbor satisfies the design and construction requirements

An owner or developer may establish compliance with the Fair Housing Act design and construction requirements by following one of the safe harbors HUD recognises, rather than by defending the built condition provision by provision. The recognised safe harbors are the listed editions of ANSI/ICC A117.1 for the adaptable-design features, and, for the requirements as a whole, the 1991 Fair Housing Accessibility Guidelines read with the 1994 Questions and Answers supplement, the 1996 Fair Housing Act Design Manual as updated in 1998, the 2000 ICC Code Requirements for Housing Accessibility, and the 2000, 2003, 2006, 2009, 2012, 2015 and 2018 editions of the International Building Code on the conditions the regulation states. Compliance with a state or local law that contains the same requirements also satisfies them.
