It also records that equity sharing was 'introduced in 1999 and enforced through deeds of covenant' on homeownership set-aside units whose buyers received City home purchase assistance, that the Office of Housing 'administers and monitors implementation of the program', that set-aside rentals are typically affordable to households up to 60 percent of AMI and ownership units up to 100 percent, and that 'Potential renters and homebuyers must meet eligibility criteria established by the City, external lenders, and leasing agents.' IT IS TEN YEARS OLD AND IS WRONG ABOUT THE BONUS: it says section 7-700 'grants bonus density of up to 20%', where the codified section says thirty percent. Both figures are recorded and neither is resolved here; the ordinance is the later and higher authority and is what the rules state.

Part 990 is overwhelmingly a SUBSIDY FORMULA, and most of it binds a budget rather than a property: eligible unit months, the project expense level, the utilities expense level, add-ons, formula income, appeals. Only a minority of it states an obligation a site manager or PHA can be held to at a property. Those are Sec. 990.215 (full operating subsidy is conditioned on compliance with the annual income reexamination requirements, and HUD may withhold an amount equal to its estimate of the lost rental income), subpart H's asset-management requirements at Sec. 990.255, 990.260, 990.280 and 990.285 (project-based management, budgeting and accounting for every PHA owning 250 or more units; project-based budgets and year-end GAAP financial statements made available to the public and distributed to the board), and Sec. 990.325 (five fiscal years' retention of Operating Fund records). The old 26.20 through 26.26 (the 95/5 option provisions) were repealed and compressed into 26.21 and 26.22. A settlement agreement, municipal ordinance or older memorandum citing '5:80-26.3' for bedroom distribution is correct as of its date and wrong today. The subchapter's title in the Code is 'Housing Affordability Controls'; 'Uniform Housing Affordability Controls' is the name on the document and in the statute. It also states the appropriations escape: 'If Congress fails to appropriate funds adequate to meet the financial needs of the assisted units, HUD will not require the Grantee to enforce the Use Agreement covered under a RAC.'

Threshold I.D requires a 20-year cash flow projection and states that 'a capital needs assessment will be reviewed every five years to insure that reserves are adequate.'
